I acknowledge that I am aware of the risks, including those associated with construction activities, related to participating in the Village Heights Action Group Project (VHAGP) at Hope Center Houston (HCH), and in consideration of being able to participate in the VHAGP, I accept those risks. To the extent that I allow my child/children to participate in the VHACP, I, agree that I am the guardian of my child, or have obtained the express agreement of my child’s guardian to allow my child/children to participate, and accordingly, I, on behalf of my child/children, myself and my child’s guardian do voluntarily elect to accept and solely assume all risk of my child’s/children’s participation in the VHAGP.
Accordingly, I, and on behalf of my spouse (if any), my child/children and my child/children’s guardian (if any), and each of our respective heirs, legal representatives and assigns (collectively Releasors) hereby release, acquit and discharge Village Heights Church, its officers, board members, employees, members, volunteers, agents, representatives, attorneys, partner organizations (including HCH), successors and assigns, along with each partner organization’s respective officers, board members, employees, members, volunteers, agents, representatives, attorneys, partners, successors and assigns (collectively Releasees) from any from any and all claims, demands, damages, remedies (at law or in equity), actions, causes of action, or suits of any kind or nature whatsoever, both known and unknown, that now or hereafter may exist, arising from or in any way relating to the VHAGP, necessarily including but not limited to personal injury, death or property damage (collectively Claims), and irrespective of whether such Claims were caused in whole or in part by my action(s), my child’s/children’s action(s), those of one or more Releasees or any third party.
Further, I agree, on my behalf and the other Releasors, to fully indemnify, defend and hold harmless each of the Releasees from any and all claims, demands, liabilities, losses, damages, or expenses, including reasonable attorneys’ fees, which any one or more of the Releasees may suffer or incur as a consequence of any attempt by a Releasor to rescind this agreement, to have any provision hereof to be declared invalid, illegal, or unenforceable, or otherwise to pursue any Claims against any of the Releasees that has been released under this agreement by the Releasors.
